Controller of the processing of personal data

Personal data is any information that can be used to identify an individual. Measures are implemented to ensure that the personal data of customers is always secure with the controllers and that the processing of personal data of customers is carried out in accordance with applicable data protection legislation, internal policies, guidelines and procedures.

The purpose of the Privacy Policy is to provide the natural person – the data subject – with information on the purpose, scope, protection and duration of the processing of personal data at the time of collection and during the processing of the data subject’s personal data.

Applicable legislation: the Personal Data Protection Act, Regulation 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (the Regulation) and other applicable privacy and data processing legislation.

What is the Privacy Policy?

The Privacy Policy is the relationship between BERMEA and the natural person (hereinafter also referred to as “User”) who contacts BERMEA and/or uses the BERMEA website and/or services provided.

BERMEA is committed to protecting the User’s personal data. The Privacy Policy enables the User to understand what information is collected when the User submits his/her data to BERMEA or BERMEA obtains possession of it in other ways, why BERMEA collects this data and how it will be used.

The Privacy Policy also provides information on how BERMEA collects, processes, stores, erases and protects User’s personal data, thereby ensuring that User’s personal data is processed lawfully, fairly and in a manner that is transparent to User. The Policy applies to the User’s personal data, any processing of natural person’s personal data and the service provided to the User.

If BERMEA updates this Policy, any changes will be posted on BERMEA’s website.

BERMEA processes data collected from the provision of services in order to provide better and more appropriate services to the User and to provide, maintain, protect and improve existing services.

For what purposes is User Data collected?

User personal data and other information is collected to:

  • offer and provide appropriate services, monitor transactions and protect Users from unlawful or harmful activities of persons, whether directly or indirectly, knowingly or unknowingly, by processing information and data that comes into their possession;
  • to process any requests for information from Users;
  • to comply with the obligations set out in BERMEA’s regulatory documents;
  • to provide support services to the User;
  • to conduct customer research, surveys and analysis;
  • to provide the User with information about BERMEA’s offers, products and services, if the User has agreed to this.

What User Data is processed by BERMEA?

Name, surname, personal identification number/date of birth, correspondence address, telephone number and e-mail address;

Bank details, if provided;

Data which the Customer himself communicates to BERMEA;

User’s IP address information;

Cookies (website browsing data);

Other personal data, depending on the type of service provided to the Customer.

This information is stored on BERMEA servers located in a secure infrastructure.

When a User interacts with BERMEA services, BERMEA servers maintain a unique activity log for the User’s security that stores certain administrative and traffic information, including:

  • IP addresses;
  • access times;
  • dates of access;
  • pages previously visited;
  • language used;
  • software error report by browser application used.

This information is important to ensure the quality of the service.

Personal information is not collected without the User’s consent.

User data will not be transferred outside the European Union or the European Economic Area, but should the need arise, User data may only be transferred to countries that provide the same level of protection for the data of natural persons as the European Union.

What means does BERMEA use to collect and process data?

BERMEA may automatically collect the aforementioned data and receive personal data that the User provides when using the Services or otherwise communicating and interacting with the Website. BERMEA may also receive personal information from other online service providers. BERMEA may also engage third party service providers to provide technical support in the provision of the Service. BERMEA has access to the information provided by the User to these service providers and third party e-commerce service providers, subject to any privacy policies.

What is the basis for processing Users’ personal data?

User’s personal consent – The User, as the subject of the personal data, by filling in the application and/or contact forms, gives his/her own consent to the collection and processing of personal data for certain purposes. The User also consents to the processing of data for direct marketing purposes, in order to make new and individual offers (this consent may, of course, be withdrawn by the User). The User’s consent constitutes his free will and independent decision, which may be given at any time, thereby allowing BERMEA to process the personal data for the specified purposes. The user’s consent is binding on him if it is given explicitly and unambiguously. The user has the right to withdraw his or her prior consent at any time through the indicated channels of communication with BERMEA . The notified changes will take effect within three working days. The withdrawal of consent shall not affect the lawfulness of the processing based on the consent prior to the withdrawal.

Service provision – In order for BERMEA to provide quality services to the User, BERMEA must collect and process certain personal data collected from the User on BERMEA’s website.

Legitimate interests – in accordance with BERMEA’s interests, which are based on providing quality services and timely support to the User, BERMEA has the right to process the User’s personal data to the extent objectively necessary and sufficient for the purposes set out in this Privacy Policy. BERMEA’s legitimate interests include the processing of personal data through direct marketing which results in new and/or individual offers of BERMEA’s services to the User.

Compliance with legal obligations – BERMEA is entitled to process personal data in order to comply with the requirements of laws and regulations, as well as to respond to lawful requests from state and local authorities.

Exceptions to disclosure of user data

BERMEA has the right to disclose personal data only in the cases provided for in the laws and regulations.

What are cookies?

Cookies are small text files that a website stores on your computer or mobile device when you visit our website. On each subsequent visit, the cookies are sent back to the originating website or to a third-party website that recognises the cookie. Cookies also allow the website to remember the settings chosen by the user on subsequent visits, so that they do not have to be re-specified each time. Cookies are not used to identify you personally.

BERMEA may use cookies as a means of obtaining information from a web server for the purposes set out above when tracking a User’s use of the Site. If the User continues to use the website, the User accepts BERMEA’s use of cookies. Cookies contain information that is transferred to the hard drive of the User’s computer. They help BERMEA to improve the website and provide a better and more personalised service.

The data collected is used by the BERMEA website operator and by Google, which collects anonymous data that is not linked to a specific person or IP address. The security of Google Analytics data is confirmed by the ISO 27001 certificate and the US and EU Privacy Shield regulations. If the User wishes to delete all cookies already stored on the computer or to stop cookies that track the User’s activities on the website, the User can do this by deleting existing cookies and/or changing the privacy settings of the browser to block cookies (the process of how this is done varies from browser to browser).

Duration of storage of personal data of users

BERMEA will process the User’s personal data as long as at least one of the following circumstances exists:

a) while the User uses the Service;

b) the retention period of the personal data is established by or results from the laws and regulations of the Republic of Latvia and the European Union;

c) it is necessary for the exercise and protection of BERMEA’s legitimate interests;

d) until the User’s consent to the processing of personal data has been withdrawn.

What are the safety conditions?

By using BERMEA’s services or by communicating with BERMEA, the User agrees to BERMEA’s terms and conditions of service.

BERMEA shall provide, keep under review and improve safeguards to protect User’s personal data from unauthorized access, accidental loss, disclosure or destruction. To ensure this, BERMEA applies state-of-the-art technology, technical and organizational requirements, including the use of firewalls, intrusion detection, analysis software and data encryption.

BERMEA carefully checks all service providers that process the User’s personal data on behalf of and on behalf of BERMEA, as well as assesses whether the cooperation partners (personal data processors) apply appropriate security measures to ensure that the processing of the User’s personal data is carried out in accordance with BERMEA’s delegation and the requirements of the laws and regulations. Business partners are not allowed to process personal data held by BERMEA for their own purposes.

BERMEA shall not be held liable for any unauthorised access to and/or loss of personal data where this is beyond the control of BERMEA, for example where the User has disclosed his/her personal data to third parties.

In the event of a compromise of the User’s personal data, BERMEA will notify the User.

BERMEA shall also notify the authorities and the natural persons involved of information/data processing security incidents or suspected incidents without undue delay within 72 hours of becoming aware of the breach, as required by applicable laws and regulations and/or European Union law, unless, in accordance with the principle of accountability, BERMEA can demonstrate that the personal data breach is unlikely to pose a risk to the rights and freedoms of natural persons.

BERMEA stores all personal information received from the User in a protected database, part of the data being encrypted, the connection of which is protected.

What are the User’s rights?

The User has the right to obtain information about those natural or legal persons who have received information about the User from BERMEA during a certain period of time. BERMEA will not provide the User with information about public authorities who are the instigators of criminal proceedings, the subjects of operational activities or other authorities about which the law prohibits the disclosure of such information.

Request the erasure or restriction of the processing of personal data the processing of which is no longer necessary in accordance with the purposes for which it was collected and processed (“right to be forgotten”).

The user has the right to the portability of his/her personal data.
